1. What HereEats is

HereEats is a marketplace that connects you with independent restaurants for delivery or pickup orders. When you place an order, your contract for the food itself is with the restaurant — they prepare it, set the prices, and deliver it (or hand it to you at pickup). HereEats transmits your order and payment terms to the restaurant and keeps you updated on its status.

2. Your account

You must be at least 16 years old, provide accurate information and verify your email address and phone number before ordering. Keep your password safe — you are responsible for activity on your account. We may suspend accounts used for fraud, abuse of restaurants or staff, or repeated failure to collect or pay for orders.

3. Orders, prices and cancellation

All prices are set by the restaurant and shown including customizations before you order. An order is a binding offer; it becomes final when the restaurant accepts it and gives you an estimated time. You may cancel free of charge while the order is still pending (not yet accepted). After acceptance, cancellation is at the restaurant's discretion, because they may have started preparing your food.

The restaurant may reject an order (for example if an item is sold out); you will be notified with the reason and will owe nothing.

Estimated times are good-faith estimates, not guarantees.

4. Payment

Unless online payment is offered and selected, you pay the restaurant directly at pickup or on delivery, by whatever means the restaurant accepts. When online card payments launch, they will be processed by our payment provider and paid out to the restaurant; additional terms will apply and will be shown before you first use them.

5. Food information, allergens and complaints

Menus, ingredient and allergen information are provided by the restaurants. If you have an allergy, use the order note and contact the restaurant directly before ordering. Complaints about food quality, missing items or delivery are resolved with the restaurant; we will assist where we reasonably can and may remove restaurants that repeatedly perform badly.

6. Reviews

You may review a restaurant only after a completed order. Reviews must be honest and lawful — no offensive content, personal data of others, or spam. We may remove reviews that break these rules.

7. Our liability

We provide the platform with reasonable skill and care, but we are not the seller of the food and are not liable for the restaurant's products or delivery performance. Nothing in these terms limits liability that cannot be limited by law (including for intent or gross negligence).

8. Changes and termination

You can stop using HereEats and delete your account at any time. We may update these terms; material changes will be announced in the app before they take effect. If you continue using the service after that, the new terms apply.

9. Law and disputes

These terms are governed by the law of your country of residence within the EU/EEA to the extent consumer law requires, and otherwise by Slovenian law. Disputes go to the competent court of your residence, and EU consumers may also use the ODR platform (ec.europa.eu/consumers/odr).
